Terms of Service & SMS Terms

Plain-language summary (not a substitute for the full Terms below): Mabel explains documents and messages in plain English and points out common warning signs of scams. It is an informational and educational service only. It is not legal, medical, financial, or tax advice; it does not block scams; and it cannot guarantee that any message is or is not fraudulent. You (and anyone you enroll) remain responsible for your own decisions. By using Mabel you accept the full Terms below, including the disclaimers, the limitation of liability, and the arbitration agreement.

1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Mabel ("Mabel," "we," "us," or "our") governing your access to and use of the Mabel website, SMS/text-message service, and related services (collectively, the "Service"). By subscribing to, texting, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service Is — and Is Not

Mabel is a text-message-based assistant that provides plain-language explanations of documents, letters, bills, and messages that users submit, and identifies common characteristics associated with fraud or scams.

3. No Reliance; Your Responsibility for Decisions

You acknowledge and agree that: (a) the Service provides general information to help you form your own judgment; (b) you will independently verify any important information before acting on it; (c) any decision to respond to, pay, sign, call, click, ignore, or otherwise act on any document or message — or not to act — is solely yours; and (d) Mabel is not responsible for the outcome of those decisions, including any financial loss. A response from the Service indicating that a message does not display common scam characteristics is not a representation that the message is safe, legitimate, or trustworthy.

4. Eligibility; Enrolling Another Person

You must be at least 18 years old to purchase a subscription. If you enroll a mobile number belonging to another person (for example, a parent), you represent and warrant that you have that person's knowledge and consent, that you are authorized to enroll them, and that you will remain responsible for the subscription. The enrolled user may stop messages at any time by replying STOP.

Responses are generated using artificial intelligence technology. AI-generated content can contain errors, omissions, or statements that appear confident but are wrong. Mabel does not review each response before it is sent. You agree that you understand these limitations and will treat every response as a helpful starting point for your own judgment — never as a definitive determination of fact, legitimacy, or safety.

8. Acceptable Use

You agree not to use the Service to: (a) submit content you do not have the right to share; (b) request assistance with unlawful activity; (c) harass, abuse, or harm others; (d) probe, disrupt, reverse-engineer, or overburden the Service; (e) resell or provide the Service to third parties as your own offering; or (f) submit another person's sensitive personal information without their authorization. We may suspend or terminate accounts that violate this section.

9. Privacy and Submitted Content

Our collection and use of information is described in the Privacy Policy. You retain ownership of the content you submit. You grant Mabel a limited license to process, store, and transmit submitted content solely to operate, secure, and improve the Service. Please avoid sending full account numbers, Social Security numbers, or passwords — the Service does not need them to explain a document.

10. Intellectual Property

The Service, including its name, branding, website, and content (excluding content you submit), is owned by Mabel and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

11. Third-Party Services

The Service relies on third-party providers, including telecommunications carriers, messaging providers, AI model providers, and payment processors. We are not responsible for the acts, omissions, outages, or policies of third parties, and your use of their services may be subject to their own terms.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, non-infringement, and any warranty arising from course of dealing or usage of trade. Mabel does not warrant that the Service will be uninterrupted, timely, secure, or error-free; that responses will be accurate, complete, or reliable; or that the Service will identify any or all fraudulent, deceptive, or harmful content.

13. Limitation of Liability

To the maximum extent permitted by law: (a) in no event will Mabel, its owner(s), employees, contractors, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of money, profits, savings, data, or goodwill, arising out of or related to the Service or these Terms — including, without limitation, losses resulting from fraud, scams, identity theft, or reliance on any response from the Service — even if advised of the possibility of such damages; and (b) Mabel's total cumulative liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of fifty dollars (US $50) or the amount you paid to Mabel in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. In those jurisdictions, liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Mabel and its owner(s), employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) content you submit; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party; or (e) enrolling a mobile number without proper authorization.

15. Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully — it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will be conducted in the county where you reside or remotely by videoconference.

You and Mabel each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or other representative proceeding. Disputes may be brought only on an individual basis.

Before filing arbitration, the party asserting a dispute must first send written notice to the other (for Mabel, at [email protected]) describing the dispute, and the parties will attempt in good faith to resolve it within 30 days. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out."

16. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs Section 15. Subject to Section 15, any claims not subject to arbitration must be brought exclusively in the state or federal courts located in Marion County, Indiana.

17. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, suspected abuse, legal risk, or discontinuation of the Service, with a pro-rata refund of prepaid fees where termination is not for cause. Sections 3, 6, and 9–19 survive termination.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by text message and/or email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be modified to the minimum extent necessary. These Terms, together with the Privacy Policy, are the entire agreement between you and Mabel regarding the Service. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
